Copyright & DMCA Policy

Copyright Notice

MONZUM respects the intellectual-property rights of others. If you believe material available through a MONZUM Service infringes your copyright, you may submit a notice under the Digital Millennium Copyright Act (“DMCA”), 17 U.S.C. § 512, to the designated agent identified on this page. Only copyright notices should be sent to the DMCA agent.

"TO BE CONFIRM"

Required Takedown Notice Content

  • Physical or electronic signature of the copyright owner or person authorized to act for the owner of an exclusive right.

  • Identification of the copyrighted work claimed to be infringed, or a representative list if multiple works at one online site are covered by one notice.

  • Identification of the material claimed to be infringing or subject to infringing activity, and information reasonably sufficient for MONZUM to locate it, including exact URL(s) where possible.

  • Your name, mailing address, telephone number, and email address.

  • A statement that you have a good-faith belief that the disputed use is not authorized by the copyright owner, its agent, or the law.

  • A statement that the information in the notice is accurate and, under penalty of perjury, that you are authorized to act on behalf of the owner of an exclusive right allegedly infringed.

MONZUM Response

When MONZUM receives a substantially compliant notice and the DMCA safe-harbor procedure applies, MONZUM will act expeditiously to remove or disable access to the material and will promptly notify the user who posted the material that it was removed or disabled. MONZUM may forward the notice or relevant information to that user as permitted by law.

Counter-Notification

A user who believes material was removed or disabled because of mistake or misidentification may submit a written counter-notification to MONZUM’s designated DMCA agent containing: (1) the user’s physical or electronic signature; (2) identification of the removed/disabled material and its former location; (3) a statement under penalty of perjury that the user has a good-faith belief the material was removed or disabled because of mistake or misidentification; and (4) the user’s name, address, and telephone number, plus the jurisdiction/service-of-process statements required by 17 U.S.C. § 512(g).

When MONZUM receives a compliant counter-notification under Section 512(g), MONZUM will promptly provide a copy to the original claimant and inform the claimant that MONZUM will restore the material in the statutory period. MONZUM will restore the material not less than 10 and not more than 14 business days after receipt of the counter-notification unless the designated agent first receives notice that the claimant filed a court action seeking to restrain the user from the allegedly infringing activity.

Repeat Infringers and Misrepresentation

MONZUM will adopt and reasonably implement a policy for terminating repeat infringers in appropriate circumstances and will accommodate standard technical measures as required for applicable safe harbor. Knowingly material misrepresentations in a takedown notice or counter-notification may result in liability under applicable law.

Other Rights Complaints

DMCA procedures are for copyright. Trademark, defamation, privacy, publicity, impersonation, synthetic-media, or other rights complaints should be submitted through MONZUM’s general legal/contact process with enough information to identify the right, material, legal basis, and complainant.
